Despite being charged with breaching the Premier League’s Profit and Sustainability Rules (PSR) for the 2022-23 season, Leicester City avoided a points deduction due to a loophole in the regulations.

However, the matter is still unresolved, with the club and the Premier League currently engaged in arbitration regarding the breach.

In response to this incident, the Premier League has revised its rulebook following a meeting with the 20 top-flight clubs earlier this month.

A new rule was introduced, which states: “If a club is relegated from the league, that club shall, notwithstanding relegation, remain bound by Rules E.47 to E.86 as if it were still a club, until such a time as it has complied with all of its obligations relating to its last season as a club.”

Financial expert Stefan Borson explained to Football Insider that the rule change closes the loophole Leicester took advantage of after their relegation to the Championship in 2023.

At that time, they successfully argued that the PSR did not apply to them because they were no longer a Premier League club at the point of assessment, which allowed them to avoid sanctions.

Borson noted that this oversight has now been addressed, with the Premier League adopting a similar provision found in the EFL’s handbook.

“There is another catch-all rule that they brought in,” Borson explained.

“When the Leicester case occurred, we discussed how the league could ensure relegated clubs still fall under the PSR regulations, despite technicalities regarding their relegation dates.”

He further clarified that Leicester’s successful appeal was based on the fact that they were no longer a Premier League club when the sanctioning process began, meaning the league lacked jurisdiction over them.
